Service Agreement

This Web Design Subscription Services Agreement (the "Agreement") is entered into between Christian Costner, doing business as CG Web Design Services ("Designer"), based in Arkansas, and [Your Full Legal Name] ([your email]) ("Client").

By typing their full legal name and submitting the signup form, Client agrees to be bound by every term in this Agreement.

CG Web Design Services operates on a monthly subscription model. Client has selected the Starter plan at $99/month, billed automatically each month.

The Starter plan includes: Custom professionally designed website with up to 5 pages, mobile responsive design, secure hosting, free SSL, basic SEO setup, contact forms, monthly maintenance and security updates, unlimited minor text/image edits, and email support.

Every active subscription includes website hosting, ongoing maintenance, security updates, technical support, and content edits based on the selected plan.

Final page count, copy, photos, brand colors, and any third-party integrations will be confirmed during the kickoff call.

No upfront payment or deposit is required.

The first monthly payment is due upon signup.

Subscription payments of $99 are automatically billed every 30 days via secure Stripe checkout.

Services remain active as long as the subscription remains active and payments are current. All payments are in USD.

All plans require a minimum 6-month commitment beginning on the date of the first monthly payment.

Early cancellation before the 6-month term may result in a cancellation fee equal to the remaining balance of the agreement (the number of months remaining in the 6-month term multiplied by $99).

Designer will begin work within 2 business days of signup and the kickoff information from Client. Estimated initial delivery is approximately 2–5 business days from kickoff.

During the build phase and throughout the active subscription, Client may request revisions to design, copy, and layout consistent with the selected plan. Revisions are reviewed within 2 business days.

Adding pages, new features, or integrations not included in the selected plan may require upgrading to a higher plan.

Client agrees to provide content (text, photos, logos, branding), feedback, and approvals in a timely manner so the project can stay on schedule.

Client warrants that any content provided (text, images, logos, trademarks) is owned by Client or properly licensed for use on the website. Client indemnifies Designer against claims arising from content Client provided.

Client may cancel at any time after the initial 6-month agreement period by providing at least 30 days written notice to Designer.

If a subscription is canceled, the website and all included services (hosting, maintenance, support) may be suspended or removed after the final billing cycle unless otherwise agreed upon in writing.

Client may cancel directly from the billing portal inside their account at any time. Cancellations within the 6-month term remain subject to the early cancellation fee in Section 4.

Websites remain the property of CG Web Design Services while the subscription is active. The subscription grants Client a license to use the website for their business for as long as payments are current.

Upon completion of the minimum 6-month agreement term, ownership transfer options may be discussed on a case-by-case basis and may involve a separate transfer fee mutually agreed upon in writing.

Client owns their own domain name directly with the registrar. Client-provided content (text, photos, logos) remains the property of Client.

Designer retains the right to display the finished website in Designer's portfolio and case studies (no sensitive Client data shown).

Payments more than 7 days overdue may result in temporary suspension of services.

Payments more than 30 days overdue may result in website suspension or termination, and any remaining balance under the 6-month commitment may be invoiced as a cancellation fee.

Designer commits to delivering the website described in this Agreement and to keeping it hosted, maintained, and supported for as long as the subscription is active and payments are current.

Designer warrants the website will function as described on current versions of major browsers (Chrome, Safari, Firefox, Edge) and on standard mobile devices. Bugs reported during the active subscription will be fixed at no additional cost.

Designer will be reasonably available by phone, text, email, and Zoom during normal business hours (9am–6pm CT, Monday–Friday) and will respond to Client communication within 1 business day.

Designer's total liability under this Agreement is limited to the total amount Client has actually paid Designer in the 6 months preceding the claim.

Designer is not liable for indirect, incidental, or consequential damages, including loss of profits or business interruption.

This Agreement is governed by the laws of the State of Arkansas, without regard to its conflict of laws rules.

Both parties agree to first attempt to resolve any dispute through good-faith direct communication before pursuing legal remedies.

By typing their full legal name in the signature field and submitting the signup form, Client agrees this constitutes a legally binding electronic signature with the same force and effect as a handwritten signature, under the U.S. ESIGN Act and applicable state e-signature laws.

Client confirms they have read, understood, and agree to be bound by this entire Agreement.
